Standard local authority TUPE and pensions clauses

Standard TUPE and pensions clauses for inclusion as a schedule to a service contract between a local authority and a service provider relating to the transfer of local authority employees who are members of the local government pension scheme (LGPS).

These clauses are loosely based on those in the Local Partnerships Workforce Matters in Local Authority Public Private Partnership Agreements© Public Private Partnerships Programme 2006, see Local Partnerships: Workforce matters in local authority public private partnership agreements, but have been reduced in size in proportion to the more common length of an outsourcing agreement. The drafting note to clause 2.3 provides some additional drafting to deal with redundancy situations.
