A Calderbank offer is a settlement offer made on a "without prejudice save as to costs" basis. Calderbank offers are also known as without prejudice save as to costs settlement offers. Calderbank offers may be used as an alternative to Part 36 offers. In many ways they are more flexible than Part 36 offers, but the costs consequences are entirely at the discretion of the court, unlike Part 36 offers.
