Employees cannot bring a free-standing claim for failure to follow the statutory dispute resolution procedures

The EAT held in Scott-Davies v Redgate Medical Services that employees do not have a free-standing right to bring proceedings for breach of the statutory dispute resolution procedures where there is no underlying statutory claim. It also held that the procedures do not apply to the right to a statement of terms under section 1 of the Employment Rights Act 1996.
