Court of Appeal agrees that provision for payment of fees on early termination by client did not invalidate DBA, in judgment highlighting difficulties with statutory DBAs regime

In Zuberi v Lexlaw Ltd [2021] EWCA Civ 16, the Court of Appeal dismissed an appeal against the High Court's decision that a damages-based agreement (DBA) was enforceable despite provision for payment of fees on early termination. While the decision to dismiss the appeal was unanimous, Lewison and Newey LJJ did not agree regarding the intended operation of key aspects of the statutory regime for DBAs.
