Claimant not a worker where the written agreement with his service companies reflected the true agreement between the parties (EAT)

In Plastic Omnium Automotive Ltd v Horton [2023] EAT 85, the EAT held that an individual engaged via his service companies was not a worker under the Employment Rights Act 1996. The contract reflected the true agreement between the parties and was also consistent with the practical reality of the parties' relationship.
