General Court judgment on whether an e-procurement system set up by a member state was a service of general economic interest

On 28 September 2017, the General Court handed down its judgment on an appeal by a number of Dutch undertakings offering e-procurement services against a European Commission decision that found that an e-procurement platform set up by the Netherlands Ministry of Economic Affairs, Agriculture and Innovation should not be considered economic in nature and that the funding of that platform did not constitute state aid within the meaning of Article 107(1) of the TFEU.
