In HMRC v Fisher [2023] UKSC 44, the Supreme Court overturned the Court of Appeal's decision, holding that the transfer of assets abroad rules did not apply to the sale of a tele-betting business by a UK family-owned company to a Gibraltar company owned by the same UK resident family members.
