In University Birmingham NHS Foundation Trust v ST and others [2023] EWCOP 40 the Court of Protection held that a 19-year-old suffering from a progressively degenerative and incurable mitochondrial disorder, lacked capacity to litigate and to make her own decisions in relation to her future medical treatment, including a proposed move to palliative care, because she did not believe the information given by her doctors.
