This is the first time the CJEU has ruled that arbitration agreements in intra-EU bilateral investment treaties (BITs) are incompatible with EU law. And while the precise scope of the Achmea decision is difficult to assess, the fate of the existing 190 intra-EU BITs seems doomed. In 2015, the European Commission started legal proceedings against several EU countries for not terminating their intra-EU BITs, as initially requested by the Commission.
