If an EPC contract transfers all design risk to the contractor, is it liable for technical inaccuracies in the FEED, which was prepared by the employer?

Anonymous (In-house)

Q:
In an EPC contract there is a front-end engineering design (FEED) endorsement clause. The clause states that the EPC contractor assumes absolute liability for the technical accuracy of the FEED provided by the owner (more specifically, prepared by a FEED contractor engaged by the owner). Are there any PLC resources discussing the scope of liability of the contractor stemming from such a FEED endorsement, or any relief to the contractor if the FEED is subsequently discovered to be technically inaccurate?
