Data concerning health

Information relating to a natural person's past, current, or future physical or mental health that reveals information about that person's health status.
The term may have specific definitions in certain jurisdictions. Under the General Data Protection Regulation (GDPR), for example, data concerning health is defined as personal data related to the physical or mental health of a natural person, including the provision of health care services, which reveal information about that person's health status (Article 4(15), GDPR). Data about health is special category data (Article 9(1), GDPR). Processing data concerning health is permitted if any of the GDPR Article 9(2) requirements are met, including where the processing is necessary:
  • For the purposes of preventative or occupational medicine, for the assessment of the working capacity of an employee, medical diagnosis, the provision of health or social care or treatment or the management of health and social care systems and services. (Article 9(2)(h), GDPR.)
  • In the area of public health, such as protecting against serious cross-border threats to health or ensuring high standards of quality and safety of health care and of medicinal products or medical devices. (Article 9(2)(i), GDPR.)
