Chinese Civil Code: Impact on Contracts

On 28 May 2020, the National People's Congress of China enacted the country's Civil Code (the Code), with effect from 1 January 2021. This note discusses the key issues and novelties in the Part on Contracts of the Code, including the changes to the general rules, sales and purchase contracts and other typical contracts such as commission contracts and intermediary contracts. It also addresses the newly introduced typical contracts as well as quasi contracts.
