In Warren v DSG Retail Ltd [2021] EWHC 2168 (QB), the High Court (Saini J) has considered whether misuse of private information, breach of confidence and the tort of negligence can be cited as causes of action in a claim for compensation for distress relating to a cyber-security breach; the claim for breach of the seventh data protection principle (data security) of the Data Protection Act 1998 was stayed pending the outcome of DSG Retail Ltd's appeal to the First-tier Tribunal (Information Rights).
