Guidance on setting aside default judgment obtained by fraud (Court of Appeal)
In Park v CNH Industrial Capital Europe Ltd (t/a CNH Capital) [2021] EWCA Civ 1766, the Court of Appeal held that a judge had been wrong to refuse to set aside a judgment in default on the basis that it had been obtained by fraud where there was overwhelming evidence that both the defendant and the court had been deceived.
