The Environment Agency published a consultation on proposals to amend its Enforcement and Sanctions Policy to reflect plans to remove the cap for variable monetary penalties (VMPs) in the Environmental Civil Sanctions (England) Order 2010 (SI 2010/1157) and to introduce powers to issue VMPs for breaches of the Environmental Permitting (England and Wales) Regulations 2016 (SI 2016/1154), on 15 August 2023.
